Monestia – Financial and Investment Management App

These Terms and Conditions are governed by Swiss law.
Any dispute shall be subject to the exclusive jurisdiction of the courts of the canton where Monestia is headquartered, subject to any other mandatory venue provided by law.
These Terms of Use (ToU) define the terms of access and use of the Monestia application, published by Monestia SA, a company under Swiss law, hereinafter "Monestia" or "the Publisher".
Monestia is an application available on the web, iOS and Android, which allows users to:
Use of the application implies full acceptance of these ToU by the user. Any registration, login or use of the service constitutes acknowledgment of reading and accepting these conditions.
Monestia strives to maintain 24/7 availability, subject to:
The user acknowledges that Monestia is not subject to any obligation of result regarding availability, but acts in best effort to restore the service as quickly as possible.
The user must create a personal account to access the chosen modules. They commit to:
Monestia disclaims all responsibility in case of unauthorized access resulting from user negligence (access sharing, weak password, phone loss, etc.).
The user is not required to provide real data that is not necessary for the operation of the modules.
Under no circumstances should they transmit bank access codes, financial institution identifiers or other personal passwords.
The application offers:
Monestia does not provide any investment advisory service within the meaning of the Financial Services Act (FinSA). The user remains solely responsible for their investment or management decisions.
Monestia makes every effort to provide reliable information, but:
The use of optimization, comparison or simulation features is at the sole discretion of the user.
Monestia, its directors and employees are exempt from all liability within the limits provided by Swiss law, particularly articles 100 and 101 CO.
The management of personal data is governed by the Privacy Policy in force. The user acknowledges having read and accepted it before any use.
All elements of the application (code, design, texts, algorithms, trademarks) are the exclusive property of Monestia SA. Any reproduction, distribution or unauthorized use is prohibited without prior written agreement.
The user can delete their account at any time, subject to the financial conditions described in the General Terms and Conditions of Sale (GTC).
Monestia reserves the right to suspend or terminate any account in case of non-compliance with these conditions, abuse, fraudulent use or illegal activity.
These GTC define the conditions of subscription, billing and renewal of paid subscriptions to the Monestia application. All prices expressed below are VAT included.

All payments are final and non-refundable.
Monestia reserves the right to modify its prices, offers or conditions at any time. Any price change will be communicated at least 30 days in advance and will only apply from the next renewal.
Monestia cannot be held responsible for:
In all cases, Monestia's liability is limited to the total amount paid by the user over the last 12 months. Any other liability is excluded within the limits provided by Swiss law.
Aspects relating to confidentiality, protection and data security are exclusively governed by the Privacy Policy in force.
The user remains solely responsible for securing their credentials, passwords and access devices.
No party may be held liable for a failure due to force majeure (Internet outage, cyberattack, war, administrative decision, natural disaster...).
